What you Need to Know About Temporary Layoffs and Return to Work
Ontario recently introduced a new Regulation to address the effect of the deemed termination provisions of temporary layoffs under the Employment Standards Act that had many employers increasingly worried as the 13-week threshold loomed.
In this session, Kecia Podetz and J.D. Sharp will explain the new Regulation, its novel approach, its benefits and limitations, and how it will affect your workforce. They will also address related return to work considerations as the province prepares for Stage 2 of its reopening plan.
Kecia Podetz, a partner with Emond Harnden LLP, is an experienced advocate who represents her clients in formal and informal settings, including grievance arbitration and human rights proceedings, mediations, interest arbitrations and in employment-related litigation. Her clients include those in the not-for-profit, health, manufacturing, technology and professional services sectors, as well as First Nation governments and related organizations.
Kecia is passionate about providing guidance and advice to her clients in their day-to-day human resources matters, including statutory compliance, development and review of employment agreements and policies, managing employee accommodation and return to work, attendance management, investigations and other matters that may lead to discipline or dismissal. Kecia’s experience combined with her plain language approach and engaging manner means that she is frequently called upon to conduct training sessions and to deliver seminars and workshops.
J.D. Sharp, a partner with Emond Harnden LLP, is a firm believer in management rights and his practice is devoted to supporting employers in effectively managing the human resources side of their organizations. He provides both public and private sector clients with strategic advice, representation and counsel regarding labour, employment, human rights, health & safety and other employment-related areas of the law.
J.D. practices mainly in the areas of labour and employment law with a particular emphasis on advocacy and litigation. In addition to providing counsel in various rights arbitrations and Labour Relations Board proceedings, he advises and represents employers on matters of labour and employment, WSIB and health and safety matters, human rights and collective bargaining and all matters related to human resources.
